Air was 'free for all' prior to the advent of civil, commercial, and military use of aircrafts. Today, by virtue of international air law there exists no 'freedom to fly'. As we know, the birth of any legal rule depends on its necessity, the need for a unified legal regime on aviation operations was felt subsequent to the first World War.
