Introduction to Marriage Laws in India

Author Name: Siva Prasad Bose | Format: Paperback | Genre : Educational & Professional | Other Details

Marriage laws form a vital pillar of India's legal system, and understanding them has never been more important. With divorce rates rising rapidly among India's new generation and matrimonial disputes becoming increasingly common, knowing your legal rights and obligations within a marriage is essential knowledge for every Indian citizen.

Written in plain, accessible language for the non-lawyer, this practical guide cuts through legal complexity to give readers a clear, comprehensive understanding of how Indian marriage law works, from the moment a marriage is solemnized to the legal processes that follow if it breaks down.

This book covers the full landscape of Indian matrimonial law, including what makes a marriage valid under the Hindu Marriage Act and Special Marriage Act, the legal distinction between void and voidable marriages, and the full range of grounds for divorce, from adultery and cruelty to desertion and mental disorder. Readers will find step-by-step guidance on contested divorce and mutual consent divorce, an explanation of judicial separation and restitution of conjugal rights, and a clear account of how courts approach mental cruelty through landmark judgments. The book also covers domicile and jurisdiction, division of property and streedhan, and two of the most widely invoked laws in matrimonial disputes — Section 498a and the Domestic Violence Act. The full text of the Hindu Marriage Act, 1955 is included as an appendix for easy reference.
